BY SUBMITTING A STORY, YOU AGREE TO THESE TERMS AND CONDITIONS, WHICH FORM A CONTRACT. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITY OBLIGATIONS ON THE PART OF SUBMITTER AND A LIMITATION OF SUBMITTER'S RIGHTS AND REMEDIES. 

ELIGIBILITY: The Nine Network Vietnam War Story Collection Project (the “Project”) is open to legal residents of the United States who are eighteen (18) years of age or older at the time of submitting a Story (as later defined in the Terms and Conditions) (the "Submitter"). All entries submitted are the property of the Submitter. The Sponsor’s database clock will be the timekeeper.

ENTRY/TIMING: The Nine Network Vietnam War Story Collection Project submission entry period begins on Monday, June 26, 2017 at 12:01:00 p.m. Eastern Daylight Time ("EDT") and ends on Saturday, November 11, 2017 at 11:59:59 p.m. EDT (the “Entry Period”). Only entries that include a fully compliant written story, video or audio story as later described in these Terms and Conditions,are eligible. NO Story will be judged however all Stories will be moderated for compliance with the Terms and Conditions. Submitting a Story does not constitute entry into any other Project or sweepstakes. By submitting a Story, each Submitter unconditionally accepts and agrees to comply with and abide by these Terms and Conditions and the decisions of Nine Network of Public Media. 3655 Olive Street, St. Louis, Mo. 63108 (the “Sponsor”), and/or Cohen-Friedberg Associates, LLC,  Framingham, MA 01702 (the “Administrator”) whose decisions shall be final and legally binding in all respects and not subject to further review in any forum. 

SUBMISSION REQUIREMENTS:

OBJECTIVE:
To collect Stories about the many perspectives of the Vietnam War from members of our community. We’re seeking Stories from veterans, those on the homefront, and those from the Vietnamese community (the “Story”). Anyone that has a Story to share from this era is encouraged to submit a Story. Every single Story is important. You can submit your Story or encourage someone you know to submit their Story.

1. Your original Story may be submitted by entering/typing your Story on the submission form page, uploading your pre-written Story or entering your Story by video, audio or photographic images on the registration page (“Eligible Entry”).

2. Your Eligible Entry must comply with these Terms and Conditions and may not contain any of the Prohibited Content set forth below.

3. All Eligible Entries will be reviewed by the Sponsor for compliance prior to being  made public.

4. The Sponsor has no obligation to publish, post or display any Eligible Entry.
  
HOW TO SUBMIT AN ENTRY: Once you are ready to share your Story, you may enter the Project in any one (1) of the following ways:

  1. Sponsor’s Microsite: Visit www.NineNet.org/VietnamStories during the Entry Period.

Complete all of the required information fields on the registration form and select the  method of Entry in order to submit your entry. Your entry will be reviewed for compliance and if approved, it may appear on the interactive Story Wall at www.NineNet.org/VietnamStories . Some Eligible Entries will be archived by the Missouri History Museum through the museum’s oral history project. If your story is selected, you will receive an email from Missouri History Museum and be invited to record your submitted story at the museum. If the Missouri History Museum chooses to feature your story at the Soldiers Memorial Military Museum, you will be contacted by the Missouri History Museum, upon which time you will receive further details and work with the representative of the Museum directly.

  1. By Mail: You may send a written/typed Story to: Vietnam Stories C/O Nine Network,

3655 Olive Street, St. Louis, MO 63108. All mail-in entries must be received by    October 31, 2017. Your entry will be reviewed for compliance and if approved, it may appear on the interactive Story Wall at www.NineNet.org/VietnamStories and some Eligible Entries will be archived by the Missouri History Museum through the museum’s oral history project. If your story is selected, you will receive an email from the Missouri History Museum and be invited to record your submitted story at the museum. If the Missouri History Museum chooses to feature your story at the Soldiers Memorial Military Museum, you will be contacted by the Missouri History Museum, upon which time you will receive further details and work with the representative of the Museum directly.

Entry Notes:  All entries are subject to verification and approval by the Sponsor. Entries that do not meet the requirements for the Eligible Entry specified below or otherwise do not comply with the Terms and Conditions herein may be disqualified. Any attempted form of entry other than as described herein is void. Sponsor will determine in its sole discretion, what constitutes a valid Eligible Entry and reserves the right to reject any submissions that it deems, in its sole discretion, to violate any of Sponsor’s policies, standards, or practices.  All materials submitted become the property of the Sponsor and will not be returned or acknowledged. 

Sponsor reserves the right to cancel or modify the Project if fraud or technical failures impair the integrity of the Project as determined by the Sponsor and at its sole discretion.

If you opt to enter via your wireless mobile device, data rates may apply according to the Terms and Conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless Internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Project. Mobile device service may not be available in all areas. Check your phone's capabilities for specific instructions. Sponsor is not responsible for any charges.

Prohibited Content:
Eligible entries must not violate the rights of any other party, including but not limited to intellectual property rights or rights of privacy/publicity. All Stories must be true. Entry submissions may not contain, as determined by the Sponsor, in its sole discretion, any:
a) sexually explicit or suggestive content; violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
b) obscene or offensive content; endorsement in any form of hate or of a hate group; appear to duplicate any other submission;
d) language that defames, misrepresents or contains disparaging remarks about other people;      
e) any personal identification, such as personal names, e-mail addresses, street addresses or license plate numbers;
f) messages or images inconsistent with the positive images and/or goodwill to which the Sponsor wishes to associate;
g) copyrighted materials owned by others will not be eligible,
h) anything that violates any law.
           
All Eligible Entries must be original works, may not have been previously published, and may not have won previous awards.  By making an entry, you represent and agree that your entry (including your Eligible video/photo/audio) will not infringe upon the intellectual property rights of any third party.  By submitting an entry, you irrevocably assign to Sponsor all right, title, and interest in your entry (including your Eligible video/photo/audio) in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for purposes of advertising or trade.  The rights granted under this paragraph shall extend to all entries and all other submitted materials related to the Project. By submitting an entry, you grant to Sponsor and its affiliated companies, the right, except where prohibited by law, to use your first name and last initial, likeness, picture, address (city and state only), and written statements.  You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), email address, biographical information, or entry.  The rights granted under this paragraph shall extend to Sponsor and its affiliated companies with respect to all Submitters in the Project.   Released Parties are not responsible for any unauthorized third party use of any submitted Story. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Submitters.
                                   
Entry Notes: Submitter will be able to review his or her Story prior to submission, but once any entry is submitted, Submitter cannot access/revise such entry in any way. Submissions made on another’s behalf (unless the submitted agrees and consents to their information being used in this project) by any individuals or other entities, including but not limited to, commercial Project/sweepstakes subscription notification and/or entering services, will be declared invalid and disqualified for this Project. Tampering with the entry process or the operation of the Project is prohibited and any entries deemed by Sponsor, in his sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.
  
Sponsor is not responsible for problems downloading or uploading any Project-related information to or from the web site or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic mail entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the web site, or any other technical problems related to web site entries including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit a Submitter’s ability to participate in this Project.

SOCIAL MEDIA DISCLAIMER: If the Sponsor provides the ability to share Submissions through social media, all Eligible Submissions posted on the interactive Story Wall may be shared by visitors to the site with the “Share This” application. This Project is in no way sponsored, endorsed or administered by, or associated with any social media.  By participating in this Project, you hereby release the released Parties from any claim, allegation, loss, or liability of any kind.  By entering, you understand that you are providing your information to the Sponsor and not to any social media.

LIMITATION OF LIABILITY:Neither Sponsor, Administrator, Project Entities, nor any of their respective parent, subsidiary or affiliated entities or any of their respective shareholders, officers, directors, employees, agents, attorneys, successors and assigns (the “Released Parties”) shall be held responsible for, and Submitter hereby releases the Released Parties from any claims arising from or in any way relating to: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Project; (iv) electronic or human error which may occur in the administration of the Project or the processing of entries; (v) any injury, death or damage to persons or property, including but not limited to Submitter's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from Submitter's participation in the Project and (vi) the selection process for posting selected Eligible Entries to the interactive Story Wall.

GENERAL CONDITIONS: The Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, delayed, postage due, garbled or damaged entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Project, including, without limitation, errors or difficulties which may occur in connection with the administration of the Project, the processing of entries, the posting of Eligible Entries to the interactive Memory Wall or in any Project-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Project. Released Parties are not responsible for injury or damage to Submitters’ or to any other person’s computer related to or resulting from participating in this Project or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Project or website or who are in violation of these Terms and Conditions, as solely determined by Sponsor, will be disqualified and all associated entries will be void. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROJECT IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. If for any reason the Project is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor, which corrupts or affects the administration or proper conduct of this Project, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Project or any element thereof. In the event of cancellation, Sponsor will select the Eligible Entries to post to the interactive Story Wall from among all eligible, non-suspect Eligible Entries received prior to cancellation.  The use of any automated launching or entry software or any other mechanical or electronic means that permits the Submitter to automatically enter repeatedly is prohibited. Any entries found or suspected to be submitted in this manner will be deemed ‘void’ by the Sponsor or Administrator. Submitters, by participating, agree that Sponsor and their respective parents, affiliates, subsidiaries and advertising and Project agencies and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, and shall be held harmless by Submitters against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from the use of their Eligible Entry or participation in this Project.

DISPUTES: Except where prohibited by law, Submitter agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Project shall be resolved individually, without resort to any form of class action, and exclusively by the  state of Missouri without regard its conflict of laws principles with venue in Missouri, and all claims must be resolved in the courts of Missouri; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Project, but in no event attorneys' fees; and (3) unless otherwise prohibited, under no circumstances will Submitter be permitted to obtain awards for, and Submitter hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Submitter and Sponsor in connection with the Project shall be governed by, and construed in accordance with, the laws of the State of Missouri, without giving effect to any choice of law or conflict of law rules (whether of the State of Missouri or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Missouri.
